Does anyone happen to know about the "rules" for submitting layouts to the magazines when you aren't the one who took the photo? For example, I have a friend who always sends me the most awesome photos of her daughter...and she is gives me permission to use them in layouts (she wants me to) and is also okay with me submitting them to magazines. And in the same respect, when you have a professional photo done, what are the rules for that (considering that the photographer have given permission for you to submit to magazines). Anyone have knowledge in this area?

Seems to me if you have permission (and a signed model release is always a nice back-up) it's fine. I don't think anyone cares that you didn't take the picture, I mean after all, you didn't take the heritage shots floating around your family....go for it!

Interesting point about the model release. So do you really think that National Geographic gets permission from those people? And what about that famous photo taken by a photographer during Viet Nam with the girl crying down the road naked because her village had been bombed. Do you think that the photographer got permission?

I think that there is something about pictures taken in public being in the public domain.... But again, I think that this may be one of those things where scrapbooking doesn't really check out what the laws actually are....

Just because we say it's so, doesn't mean it is so.

There are anti-trust, anti-trade, and anti-discimination laws etc. that are on the books that some companies in this industry just haven't been made to obey. And until somebody points out to them that what they are asking is wrong, they will keep asking people to do things that are wrong....

I think news stories are different, but i know that from my experience with broderbund, model releases are key, so i have them. will save me later, if needed, and i can only take care of me.

I have a journalism backgroundm and I can absolutely say that a news shot in a news magazine or newspaper is totally different - public events at public places are fair game. Photos of small children with their name and possibly other information being used in a scrapbooking magazine without the parents' approval is different.

If you have a signed model release, copyrights to the photo and give credit to the photographer, you're fine.

I just had a case where my work was considered for publication in which I took the photo, but it wasn't my kid. I found out that you need the parents signature to verify that "this is my kid and I give permission to use this photo etc." I think if you have that you're pretty safe.
If you didn't take the photo you'll need a signed release that states that you have the permission to use the photo for any publication work.
I guess it all comes down to -1. an model release and 2. a photographers release. With those two you should be able to submit any work that you have using other people pictures/kids in pictures.

A lot of times, the magazine that wants your layout will have a release included with the required paperwork. You would get that signed by whomever and send it back the mag. I would also keep a copy myself.

My question on this topic is about protecting the identification of the innocent. I have a LO I did of a friends child, is it OK to fudge the info on the LO? After all who would know except for me and the family. I do have permission to use it.

Does that make sense? LOL

It's definately okay, Dee. In fact, if the info is actually on the layout, I've seen published layouts where that info has been blurred.

I've also seen the children whose parents didn't sign a release blurred as well. Usually in a large group shot.

good info to know... though I don't normally submit, it's nice to keep in the back of my head. I'm working on a layout now that I'm hesitating to upload because I'm not sure everyone in it would like to be on the net (I'm going to blur them, I guess!)
